Terms and Conditions

By entering the TrueLocal "Promotion", you are agreeing to the following terms and conditions:

  1. Standard Terms
      1.1. Information on how to enter forms part of the terms of entry.
  2. Who can enter?
      2.1. Subject to clause 2.2, entry is open to all Australian residents aged 18 years or over. Employees, directors and management of the Promoter of the competition and the immediate families of these persons are ineligible to enter.
      2.2. Employees and their immediate families of News Limited and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  3. How to enter?
      3.1. The competition commences on Friday 1 March, 2013 at 8:00 ADST and concludes on Friday 29 March, 2013 at 17:00 ADST (Competition Period). The time of entry will in each case be the time the entry is received by email database. The promoter accepts no responsibility for any late, lost or misdirected entries not received by the Promoter or delays in delivery due to the technical disruptions, network congestion or for any other reason.
      3.2. In order to enter the competition, eligible entrants must, during the Competition Period, sign up to the Business Newsletter by;
        3.2.1. Using the sign up form on http://www.truelocal.com.au/info/business-newsletter;
        3.2.2. Enter your first name and email address on the sign up form.
      3.3. Entrants of the competition can only enter once during the Competition Period, provided the email address is an actual and current email.
      3.4. The time of entry will in each case be the time received by TrueLocal’s email platform database.
      3.5. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
      3.6. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
      3.7. By entering the promotion the entrant agrees that the Promoter may contact them about future marketing and sales purposes.
  4. Prizes
      4.1. The first 100 eligible entrants to enter will win a TrueLocal Priority Listing Advertising for 3 months valued at $264.00 each.
      4.2. Total prize value is approximately $26,400.00.
      4.3. Prizes are not transferable or exchangeable and cannot be taken as cash.
      4.4. If any of the Prizes remain unclaimed by 5.00pm (AEST) on Tuesday 2 July 2013 the determination of the next winner/s who were the first to enter will take place at 10.00am (AEST) on Tuesday 9 July, 2013 at the same time and place as the original determining of winners, subject to any law or directions from a regulatory authority. Any such winners will be notified by email and they will be published in The Australian newspaper on Tuesday 16 July 2013.
      4.5. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
      4.6. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
  5. How to win
      5.1. Each eligible entrant who has entered the competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the competition.
      5.2. Winners will be determined at News Digital Media, 175 Liverpool St Sydney NSW at 10am (AEST) on Tuesday 2 April, 2013.
      5.3. The criteria for awarding the prizes will be based on the first 100 entrants who successfully sign up to the TrueLocal newsletter and are recorded in Promoter’s email platform database.
      5.4. The winners notified by email on Thursday 4 April, 2013, and published in The Australian newspaper on Tuesday 9 April, 2013. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
      5.5. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
  6. No liability
      6.1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
      6.2. As a consequence of late, lost or misdirected mail;
      6.3. News Limited and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
        6.3.1. In the participation in any prize;
        6.3.2. As a consequence of late, lost or misdirected mail;
        6.3.3. Due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
        6.3.4. In relation to failure of an online entry to be received by the promoter on account of technical problems or traffic congestion;
        6.3.5. Due to circumstances outside the Promoter’s reasonable control;
      6.4. News Limited and its affiliates assume no responsibility for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
      6.5. If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.
      6.6. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
      6.7. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to TrueLocal and not to Facebook. The information you provide will only be used for the purposes as disclosed in the above terms and conditions.
  7. Privacy Policy
      7.1. TrueLocal.com.au is collecting your personal information as set out in the competition entry form to process your competition entries. We may share your information with other persons or entities who assist us in running this competition (or with other companies who provide prizes for this competition). You can gain access to your personal information by contacting our privacy officer at Level 23, 175 Liverpool St Sydney NSW 2000.
