Tasmanian Perpetual Trustees Estates and Wills

Unauthorised property access by beneficiaries family. Subsequent TPTL letter did not detail lock change reason, wording was "due to disagreement". No questions whether items removed.

TPTL favourable to hidden bids on chattels, the most fair option to all beneficiaries. TPTL then disagreed, no explanation. Subsequently received chattel list, most desired items nominated in other beneficiaries names. TPTL were questioned if other beneficiaries drafted the list, no response. Clearly unfair, I could not agree to this method of sale. Result was chattels going to public auction with most items going to the public.

TPTL were aware of jewellery held by a beneficiary in December 2013. TPTL took action in May (after I asked where the jewellery was) to recover (beneficiary initially claimed other beneficiaries were witness to ring being promised to her as a gift, which when challenged, backed off).

TPTL informed formally in October 2013, verbally earlier, of a loan to the same beneficiary from the deceased. Two payments were made, receipt(s) noting "repayment of loan" in August. Followed this up with TPTL in June. Beneficiary now claims the loan was a "gift".

Email to TPTL 3rd December 2013, wrote about a box marked with my name. Contained items the deceased had created an express trust would be returned to me. The wishes of the deceased had been mentioned to TPTL on a visit to the house where I also pointed out the box and informed her the other beneficiaries had boxed up those items and clearly marked the box with my name.

Method of sale of the house letter sent by TPTL mentioned only private treaty sales. The 'Letter of Direction' returned also only mentioned a fixed asking price. The option of auction should have been on the letter as it was unclear this was an option.
